1. Agreement to Terms

By accessing or using the website and services provided by Prime Touch Solutions LLC("Prime Touch," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

2. Description of Services

Prime Touch Solutions provides healthcare staffing services, connecting qualified and credentialed healthcare professionals with healthcare facilities across the state of New York. Our services include per-diem staffing, long-term assignments, emergency staffing, allied health placement, and weekend/overnight coverage.

3. Eligibility

You must be at least 18 years of age and legally authorized to work in the United States to use our placement services as a healthcare professional. Facilities must be licensed and authorized to operate within their jurisdiction.

4. Healthcare Worker Responsibilities

Healthcare professionals placed through Prime Touch agree to maintain all required licenses, certifications, and credentials throughout their assignment. Workers must comply with all applicable federal, state, and local regulations, including HIPAA, OSHA, and facility-specific policies. Providing false or misleading credential information is grounds for immediate termination of the placement relationship.

5. Facility Responsibilities

Facilities engaging Prime Touch agree to provide a safe working environment in compliance with applicable labor laws. Facilities must supply accurate staffing requirements and promptly communicate any changes to assignments. Payment terms are governed by the separate Staffing Services Agreement between the facility and Prime Touch.

6. Credentialing and Compliance

Prime Touch verifies credentials, performs background checks, drug screenings, and ensures HIPAA training for all placed healthcare professionals in accordance with New York State Department of Health regulations, including Article 29-K requirements where applicable. While we take every reasonable step to verify qualifications, facilities retain the right to conduct their own verification.

7. Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Prime Touch Solutions LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Limitation of Liability

To the fullest extent permitted by law, Prime Touch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim related to our services shall not exceed the fees paid by you to Prime Touch in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Prime Touch Solutions LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

10. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, all provisions that by their nature should survive will continue to apply.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of our services after any changes constitutes your acceptance of the revised terms.
